1. ACKNOWLEDGMENT OF SERVICES
I understand that Utah Outdoor Therapies (“UTOT”) is a nonprofit organization that provides outdoor, indoor, and adventure-based recreational activities for treatment centers, businesses, healthcare providers, and other community groups.
I understand and acknowledge that UTOT does not provide therapy, counseling, medical treatment, mental health treatment, behavioral intervention, crisis stabilization, transportation, or clinical services, unless expressly stated otherwise in writing.
UTOT provides activities, logistical coordination, and equipment as applicable. Any treatment, supervision, medication management, behavioral support, transportation, or clinical decision-making remains the responsibility of the participant, parent/guardian, treatment center, program staff, business, or referring organization, as applicable.
2. ACTIVITIES COVERED
This Agreement applies to all UTOT activities, whether conducted indoors or outdoors, at public or private locations, and whether facilitated directly by UTOT or in coordination with a third-party venue, guide, outfitter, landowner, or partner organization.

3. ASSUMPTION OF RISK
I understand that participation in UTOT activities involves inherent, obvious, and unforeseeable risks, including but not limited to:
Slips, trips, falls, collisions, or loss of balance;
Falling from height or impact with rocks, trees, equipment, structures, watercraft, or other persons;
Drowning, near-drowning, capsizing, immersion, cold-water exposure, or other water-related hazards;
Exposure to heat, cold, snow, ice, rain, wind, lightning, sun, altitude, or changing weather conditions;
Wildlife, insects, plants, allergens, and environmental hazards;
Equipment misuse, equipment malfunction, or equipment failure;
Physical exertion, fatigue, dehydration, overexertion, panic, stress, emotional distress, or aggravation of preexisting conditions;
Transportation-related risks before, during, or after the activity, whether transportation is arranged by the participant, Client organization, or another third party;
Acts, omissions, or negligence of participants, staff, volunteers, third-party providers, venue personnel, or members of the public;
Serious bodily injury, illness, disability, emotional harm, property loss, or death.
I understand that not all risks can be anticipated or eliminated, and I voluntarily choose to participate (or allow my minor child to participate) with full knowledge and acceptance of these risks.
I knowingly and voluntarily assume all risks, whether known or unknown, inherent or otherwise, associated with participation in any UTOT activity.
4. RELEASE OF LIABILITY AND WAIVER OF CLAIMS
In consideration for being allowed to participate in activities with UTOT, I, on behalf of myself and/or the minor participant, and on behalf of my heirs, assigns, estate, personal representatives, next of kin, insurers, and any other persons acting on my behalf, hereby fully and forever release, waive, discharge, and covenant not to sue UTOT and its officers, directors, employees, volunteers, contractors, instructors, guides, agents, affiliates, partner organizations, host sites, venue operators, landowners, and representatives (collectively, the “Released Parties”) from any and all claims, demands, actions, causes of action, liabilities, damages, losses, costs, or expenses of any kind, whether known or unknown, arising out of or related in any way to participation in any UTOT activity, including but not limited to claims for:
Personal injury;
Illness;
Emotional distress;
Property damage or loss;
Disability;
Wrongful death; or
Any other loss or harm.
This release includes claims arising from the ordinary negligence of the Released Parties, to the fullest extent permitted by law.
This release does not apply to gross negligence, reckless misconduct, or intentional misconduct to the extent such claims cannot legally be waived under applicable law.
5. MEDICAL, MENTAL HEALTH, AND BEHAVIORAL RESPONSIBILITY
I understand and agree that:
UTOT staff and volunteers are not physicians, therapists, counselors, nurses, behavioral technicians, case managers, or other licensed healthcare or mental health professionals by virtue of their role with UTOT;
UTOT does not provide medical care, mental health treatment, behavioral intervention, medication administration, or crisis stabilization;
I am solely responsible for determining whether I (or my minor child) am physically, mentally, and emotionally able to safely participate;
I am responsible for disclosing any relevant medical, physical, mobility, sensory, behavioral, psychological, or safety concerns that could affect participation;
I am responsible for bringing and managing all necessary medications, inhalers, EpiPens, adaptive devices, or other personal medical items;
If participation is through a treatment center, school, provider, or other organization, that organization remains responsible for participant supervision, treatment, behavioral intervention, medication administration, and clinical decision-making.
I understand that UTOT may deny participation, limit participation, or remove a participant if UTOT determines, in its sole discretion, that participation may be unsafe.
6. EMERGENCY AUTHORIZATION
In the event of illness, injury, accident, or other emergency, I authorize UTOT to:
Provide basic first aid within the scope of staff or volunteer training, if available;
Contact emergency services, law enforcement, or other first responders;
Notify the listed emergency contact and/or the referring organization, treatment center, or group contact;
Arrange or request emergency transportation if deemed reasonably necessary.
I understand that UTOT does not guarantee on-site medical personnel or immediate emergency response.
I agree that I am solely responsible for any and all medical, ambulance, hospital, treatment, transportation, or related costs incurred on my behalf or on behalf of the minor participant.
